Order Terms and
Conditions
An online order
is a Sales Contract An order placed
online is a sales contract between Alpha Nutrition Online, a division of
Environmed Research Inc. hereafter called the Seller and you, the Buyer. By
placing and order online, you are entering a sales contract
with the Seller. Both parties accept duties and obligations. By placing an order online,
the Buyer acknowledges and agrees to
the following terms and conditions of sale.
Payment for
products ordered online shall be may in advance of the order
shipment by credit card, Pay Pal, money order or other electronic transfer of funds.
The seller reserves the right to alter or refuse an order by notifying
the Buyer by email and by refunding money already paid by the Buyer. The
Buyer warrants that payments made by Pay Pal and/or credit card banks are final and binding on the buyer and cannot be refunded by charge back.
The Buyer further agrees to notify the seller if he or she or wants to return products and will request refund according to the refund
conditions declared herein.
Delivery
Time Canada Post and the US
Postal Service determine the time it takes
to deliver your order. Post Office
performance is beyond our control. You
will receive a link to tracking
information by email that includes an
expected delivery date. Overall, Express
Post in Canada and Priority Post in the US
performance is excellent; however,
occasionally, shipments are delayed but
rarely are lost. Delivery time can be
prolonged by longer distance, adverse
weather and problems with your local
postal delivery arrangements. Shipments to
the US also can be delayed by US customs.
Receiving
Shipment By placing an order, the Buyer warrants that the delivery
address is complete and correct and that he or she will be available to
receive the shipment or will delegate the responsibility of receiving
the shipment to a responsible party. The sellers obligation to deliver
the order ends with delivery to the regional post office.
All costs incurred by failed
delivery to the address supplied by the Buyer will be paid by the Buyer.
The seller accepts no responsibility for the cost of goods when delivery
is refused by the buyer, lost by the Post Office, or for goods stolen or
damaged. The buyer will receive ample notification by email of the order
shipment and will also receive tracking information from Canada Post
which applies to both Canadian and US deliveries.
Warranty
against Defects of Products The Seller warrants that the Products are fit for their intended purpose
when stored and used correctly. All user information is posted online
and should be read before an order is placed. If the Buyer fails to notify
the Seller within 5 days or
the Products are already in use, the Products are deemed to have been
accepted and cannot be returned for credit.
There is no warranty expressed or
implied pertaining to the use of information supplied or the use of
nutrients formulas. The Buyer accepts responsibility for the proper
storage and use
of nutrient formulas and will seek professional supervision whenever
necessary.
Notification
of Loss, Damage to, or Non Delivery of Goods or Packages
In the event of any damages on delivery the Buyer must
notify the Seller and the Carrier immediately in writing, otherwise no
claim can be entertained. At the same time the Buyer must mark and/or
make a reservation on the delivery note or on a similar document upon
receipt of goods and - if possible - have it countersigned by the
Carrier's driver.
Returns and
Refunds
Please note all
discounted sales are final with no return privileges.
Starter packs are sold at a discount and are
not refundable. Printed texts are refundable only if returned unopened in
original shrink-wrap. eBooks are not refundable. No refunds are paid on deliveries outside Canada and the
continental USA.
Please notify us by email and obtain instructions
for returning any Alpha Nutrition Products. You may not receive refund credit unless you
have contacted us first.
Force
Majeure The Seller shall be relieved of the performance of its obligations for
the duration and to the extent that it is prevented in the performance
of its obligations by reasons of force majeure. For purposes of this
clause, force majeure is defined as circumstances or events which have
not been foreseen at the time of entering into this transaction, which
are not the fault of the Seller and which prevent the performance of all
obligations hereunder and which are not capable of being remedied.
Assignability This contract is personal to the parties hereto and shall not be
assigned to any third party by either the Buyer or Seller, without the
other party's written consent.
Law and
Jurisdiction All sales contracts shall be deemed to be made in British Columbia, Canada and
governed in all respects by Canadian and British Columbia Law.

and services.
International Customers
We encourage
international customers to order eBooks rather than print books.
The cost of shipping books is increasing. eBooks are low cost with no
shipping charges. Downloads are immediate. Persona Publications
is separate website for the download of eBooks and other digital documents.
We are sorry to say that
we seldom ship formulas overseas due to the excessive cost of shipping
plus importation rules and costs. See International
Orders.
